Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download or use the App.

Use License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service.

You may not:

• Modify, reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Use the App for any unlawful purpose
• Remove any copyright or proprietary notices from the App
• Attempt to bypass any security features of the App

App Content and Purpose

Rise Now is a habit tracking application that uses gamification and accountability psychology to help you build habits. The App includes features such as streaks, badges, XP (experience points), levels, and "stakes" mechanics designed for motivational purposes.

Important: The App is intended for general wellness and productivity purposes only. It is not a substitute for professional medical, psychological, or health advice. If you have concerns about your mental health or habits, please consult a qualified professional.

Subscriptions and In-App Purchases

Rise Now may offer premium features through auto-renewing subscriptions and one-time in-app purchases. By purchasing a subscription or in-app purchase, you agree to the following terms:

Subscription Terms

• Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original subscription.
• Free Trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.

Managing Subscriptions

You can manage and cancel your subscriptions by going to your App Store account settings after purchase. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.

To cancel your subscription:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select Rise Now
5. Tap "Cancel Subscription"

No Refund Policy

ALL SALES ARE FINAL. We do not offer refunds for subscriptions or in-app purchases. By making a purchase, you acknowledge and agree that all payments are non-refundable.

All purchases are processed through the Apple App Store. We do not have access to your payment information and cannot process refunds under any circumstances. While Apple has the sole discretion to grant refunds in exceptional cases as determined by their policies, we do not guarantee or facilitate any refunds.

If you wish to request a refund from Apple, you may contact Apple Support or submit a request through your App Store purchase history. However, please note that refund requests are subject to Apple's sole discretion and are generally not granted except as required by applicable law.

Important: Canceling your subscription will stop future billing but will not refund any payments already made. You will retain access to premium features until the end of your current billing period.

Price Changes

We reserve the right to change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next subscription period following notice of the price change. We will notify you in advance of any price changes.

In-App Purchases

One-time in-app purchases (such as Life Savers, premium characters, or other features) are non-refundable except as required by law. These purchases are tied to your Apple ID and are non-transferable.

Gamification System

Rise Now includes a gamification system with the following elements:

• XP (Experience Points): Virtual points earned by completing habits and maintaining streaks
• Levels: Progress indicators based on accumulated XP
• Badges: Virtual achievements for reaching milestones
• Streaks: Consecutive days of habit completion
• Stakes & Consequences: Gamified XP and badge mechanics designed to encourage accountability

All gamification elements are virtual rewards with no monetary or cash value. "Stakes," "consequences," and "loss" mechanics refer exclusively to virtual XP, badges, and progress within the App, not real money or tangible assets.

Intellectual Property

The App and its original content, features, and functionality are owned by Antler Web Studios and are protected by international copyright, trademark, and other intellectual property laws.

App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to App Store-related matters.

Apple Standard EULA

If you purchase a subscription or make an in-app purchase through the Apple App Store, you acknowledge and agree that you are also bound by Apple's Licensed Application End User License Agreement (EULA).

The Apple EULA governs your use of the App as downloaded from the Apple App Store, including all in-app purchases and subscriptions processed through Apple.

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will help you achieve any specific habit-related goals, that it will be uninterrupted or error-free, or that it will be compatible with all iOS devices or versions.

Limitation of Liability

To the fullest extent permitted by applicable law, Antler Web Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, regardless of whether such damages were foreseeable.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or on our website. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
